SINGLE USE PLASTICS


Act amending the act on quantitative obligations in the field of waste management and product fee and other acts in force May 24, 2023.

Its aim is to reduce the amount of waste generated from single-use plastic products present in the natural environment, which pose a threat to, among others, for human life and health.

The Act imposes new obligations on the Entrepreneur who manufactures disposable products or uses such products in everyday business, i.e.:

  • entry and entry update in the BDO device - by August 24, 2023.,
  • ban on placing on the market,
  • labeling of products in accordance with the pattern set out in Commission Implementing Regulation (EU) 2020/2151 of December 17, 2020,
  • limitation of use,
  • collection and payment of fees,
  • record keeping already from May 24, 2023,
  • new design of bottles - beverage containers with a capacity of up to three liters from July 3, 2024 must have caps and lids attached,
  • ensuring the availability of alternative packaging – from July 1, 2024,
  • education, i.e. conducting public educational campaigns by: allocating the fee in a given calendar year to public educational campaigns or transferring the fee to a separate bank account of the province marshal.

The Act also defines the obligations of the Entrepreneur placing fishing gear containing plastic on the market. These are the achievement of a minimum annual collection rate and record keeping.
