What kind of permits are we dealing with in the waste area:

• permit to collect waste;
• permission to process waste;
• permission to collect and process waste;
• a permit for the generation of waste, taking into account the collection and processing of waste.

When do you need to obtain a permit:

• if you produce non-hazardous waste with a mass exceeding 5,000 Mg per year;
• if you produce hazardous waste weighing more than 1 Mg per year;
• if you collect waste (remember about exceptions, eg: having a waste collection permit does not apply to: collecting medicines and their packaging by pharmacies, waste generated by their producer, if they are collected at the place where they are generated );
• if you process waste, i.e. the activity consists in recovering secondary raw materials in production processes (so-called recycling) or neutralizing waste in technical installations (e.g. by incineration or by appropriate storage).

Procedure for obtaining a permit:

	Determining the types of waste and the amount of waste generated in connection with the operation of the installation, Determination of the total capacity (expressed in Mg) of the installation, building structure or part thereof or other waste storage location;
	Preparation of an application for the generation of waste, collection and / or processing of waste together with the waste survey and fire protection survey
	Submission of the application to the office empowered to issue the decision along with the payment of the license fee
	Commencement of the administrative procedure
	Give of decision

Remember: 

• the application should be submitted at least 2 months before the intended date of commencement of business;
• an administrative penalty in the amount of PLN 10,000 to PLN 1,000,000 for running a business consisting in collecting waste and processing waste without the required permit;
• the application for waste collection, waste processing must be accompanied by a fire inspection report, which includes the conditions of fire protection of the installation, facility or part thereof or other waste storage place, agreed with the poviat (municipal) commander of the State Fire Service;
• depending on the type of investment, the office may also require a decision on environmental conditions to be attached to the application
• The operation of an installation for which the required integrated permit has not been obtained may be suspended by the competent voivodeship environmental protection inspector;
• Additionally, the operation of the installation without the required integrated permit is punishable by detention, restriction of liberty, or a fine.
