DEPOSIT SYSTEM
On July 13, 2023, the Sejm passed an act introducing a deposit-refund system in Poland.
The Act enters into force 30 days after its announcement, i.e. on August 11, 2023.
The creation of a deposit-refund system will support the achievement of the goal of selective collection of plastic beverage packaging, and will facilitate the multiple use of glass packaging and the selective collection and recycling of metal cans
The deposit system will be set up by entrepreneurs introducing products in beverage packaging and directly introducing products in beverage packaging covered by the deposit system.
The introducers will be represented by the so-called representing entity, responsible for managing the system.
The Representing entity will submit an annual report to the minister responsible for climate, which will include, among others, Information about:
- The amount of funds allocated for the operation of the bail system;
- The amount of the unclaimed deposit;
- the mass of packaging and packaging waste collected separately under the deposit system.
Commercial units with an area of not more than 200 m2 will be required to participate in the deposit system for at least collecting deposits, and may participate in the system for returning deposits and collecting empty packaging and packaging waste.

The deposit will be added to:
- Disposable plastic bottles with a capacity of up to 3 liters;
- Reusable glass bottles up to 1.5 liters;
- Metal cans with a capacity of up to 1 liter.
According to the draft regulation published in April, the deposit is to be 50 gr.
The deposit will be refunded when the packages are returned to the store without the need to show proof of purchase.
If the deposit is not collected, it will be used to finance the bail system.
The new regulations go into effect on January 1, 2025.
