New rules for sorting construction waste


Starting January 1, 2025, there will be major changes in the management of construction waste.

CHANGES

New art. 101a The Waste Act requires the selective collection and removal of construction and demolition waste and its sorting into fractions:

  • wood,
  • metals
  • glass,
  • plastics,
  • plaster,
  • mineral waste, including concrete, brick, tiles, and ceramic materials
  • rocks.

If the collected waste has not been sorted correctly, it must be sorted. It is therefore possible to collect and remove unsorted waste, but it must be sorted. Sorting should be based on an appropriate decision, as waste sorting is a recovery process.

 

EXEMPTION

The sorting obligation does not apply to:

  • households;
  • selective municipal waste collection points (PSZOKs) and
  • types and quantities of construction and demolition waste for which there is no obligation to keep records of waste specified in the regulation on types of waste and quantities of waste for which there is no obligation to keep records of waste (Dz.U. 2019 poz. 2531)

 

ADMINISTRATIVE PENALTIES

Article 194(1)(6a) is closely related to Article 101a of the Waste Act and will also come into force on January 1, 2025:

“An administrative fine shall be imposed for failure to conduct selective collection, collection, and sorting of construction and demolition waste, contrary to the obligation specified in Article 101a.”
