The Water Law Act imposes a number of obligations aimed at sanctioning the use of water. One of them is the obligation to obtain a water permit.
When do you need to obtain a water permit:
for abstraction of groundwater or surface water;
damming, storage or retention of groundwater and surface waters and their use;
for the collection and treatment of sewage;
to discharge sewage into waters or into the ground (sewage: industrial, technological, wash water, rainwater and meltwater, etc.);
to discharge industrial wastewater to the sewage system of another entity;
permanent drainage of land, structures or construction excavations;
discharge into waters or into the ground of abstracted and unused waters;
for the construction of water devices (e.g. retention reservoirs, rainwater drainage outlet, ditches and canals, wells, etc.);
when you plan to locate a new project or construction object in areas of high flood risk, or you will collect sewage or store chemicals or process waste.
Note - for the implementation of some projects, you only need a water-legal notification.
Procedure for obtaining a permit:
Determining the scope of water use
Preparation of an application for a water-law permit together with a water-law survey
Submission of the application to the Office empowered to issue the decision along with the payment of the fee for issuing the permit
Commencement of the administrative procedure
Give of decision
Remember:
The increased fee is treated as an administrative fine and is a sanction either for the lack of a water permit or for violating the conditions specified in this permit;
The operation of an installation for which the required integrated permit has not been obtained may be suspended by the competent voivodeship environmental protection inspector;
Additionally, the operation of the installation without the required integrated permit is punishable by detention , restriction of liberty, or a fine
