Air emissions and noise


The Environmental Protection Law imposes a number of obligations aimed at sanctioning the use of various elements of the environment.

Air emission

One of them is the obligation to obtain a permit for the introduction of gases and dust or
to notify the installation which is the source of organized or unorganized emissions.

Devices such as a heating boiler, dryer or paint shop are installations installations that emit many substances into the air. If the emission takes place in an organized manner, e.g. through a chimney or by means of mechanical ventilation, the introduction of substances into the air from these installations usually requires a permit. For some installations, when emissions take place in an unorganized manner, it may also be necessary to have a permit to discharge gases or dust into the air.

Some installations that do not require a permit may require notification.

When do you need to obtain a permit:

  • when introducing gases and dust into the air from the conducted installation
    in an organized manner;
  • when introducing gases and dust into the air from some unorganized sources;
  • in the event of the intention to operate a newly built installation;
  • in the event of a system conversion.


Procedure for obtaining a permit:

Determining whether an organized or unorganized emission takes place from the installation. Checking whether the installation is exempt from obtaining a permit or notification
Preparation of an installation notification or an application for a permit together with an air protection survey
Submission of the application to the Office empowered to issue the decision along with the payment of the fee for issuing the permit
Commencement of the administrative procedure
Give of decision

Remember:

  • The intention to operate a newly built installation or a reconstructed installation should be reported 30 days before the planned date of commencement of operation.
  • The operation of an installation for which the required integrated permit has not been obtained may be suspended by the competent voivodeship environmental protection inspector;
  • Additionally, the operation of the installation without the required integrated permit is punishable by detention , restriction of liberty, or a fine
